Aeroklas would like to inform you that this Privacy Notice for Business Owners (“Privacy Notice”) applies to you (1)
If you register on the website operated by Aeroklas (collectively, the “Website”) as an Entrepreneur, whether you register on the Website for yourself as an Entrepreneur who is an individual (“Entrepreneur”) or register on the Website for or on behalf of a legal entity (“Entrepreneur”) of which you are a representative, such as in cases where you are a contact person, employee, representative of such legal entity, including authorized directors (collectively, the “Related Persons of the Entrepreneur” and the Entrepreneur and the Related Persons of the Entrepreneur are collectively referred to as the “Entrepreneur”), and (2) if Aeroklas needs to process your Personal Data, including the collection, recording, use and disclosure of your Personal Data for the normal course of business of Aeroklas and for the purposes detailed below, then Aeroklas would like to inform you of the details of such processing of Personal Data, which are as follows:
1. Definition
In this Privacy Notice, the following terms shall have the meanings set out below unless the context otherwise requires.
“Foreign legal entity” means any affiliated company and associated company of Aeroklas which may be located in or outside Thailand.
“Personal Data Protection Act” means the Personal Data Protection Act B.E. 2562 and any rules, regulations, guidelines, announcements and orders issued under the power of the Personal Data Protection Act, as may be amended, supplemented or replaced from time to time.
“Personal Data” means any information about a natural person which allows the identification of that natural person, either directly or indirectly.
But it does not include information about deceased persons.
“Processing” means the collection, use, disclosure, transfer, storage or processing of personal data.
“Sensitive personal data” means the types of personal data specified in Section 26 of the Personal Data Protection Act, including personal data regarding race, ethnicity, political opinions, religious or philosophical beliefs, sexual behavior, criminal history, health information, disability, trade union information, genetic information, biometric information or any other information which affects the owner of personal data in a similar manner as specified by the Committee.
2. Processing of personal data
2.1 Aeroklas uses its best efforts to collect only personal data that is necessary, relevant and appropriate to achieve the purposes set out in this Privacy Notice. The types of personal data processed by Aeroklas include:

2.2 Sensitive Personal Data Aeroklas has no intention or necessity to process your sensitive personal data, including data relating to your religious beliefs and/or blood type which may appear on your national ID card copy. Please therefore ensure that you remove your sensitive personal data (if any) from your national ID card copy before submitting it to Aeroklas.
2.3 For corporate entities, Aeroklas may collect company documents from you or other agencies which contain personal information of your related personnel, such as company certificates and shareholder lists.
3. Purpose of processing personal data
3.1 Aeroklas endeavors to collect only necessary and sufficient personal data, but not more than is necessary for the purposes set out below in this Privacy Notice.

3.2 Where the legal basis for processing your Personal Data is to enter into a contract with you or to perform a contractual obligation, failure to provide Personal Data under such circumstances may result in our being unable to enter into the contract and/or perform our contractual obligations, in whole and/or in part.
3.3 Where the legal basis for processing your Personal Data is to comply with a legal obligation, failure to provide Personal Data under such circumstances may result in Aeroklas and/or you being in breach of or in violation of any applicable law, regulation, court order or order of a competent authority.
3.4 If Aeroklas needs to use your personal data for purposes other than those set out above, we will inform you of such new purposes and, where required by law, we will seek your consent to use such personal data, unless otherwise required by law.
4. Disclosure or transfer of your personal data outside your country
4.1 Aeroklas may disclose your personal data to Aeroklas personnel and officers for the purposes set out in this Privacy Notice. Only duly authorized personnel of Aeroklas are permitted to access the Operator’s personal data and Aeroklas will not disclose such personal data to any third party except in the circumstances set out in this Privacy Notice.
4.2 Aeroklas may disclose and/or transfer your personal data to the following persons/entities from time to time, where such persons/entities may be located in or outside of Thailand:
4.2.1 Our third party vendors, such as information technology service providers, cloud service providers, accounting service providers, legal consultants, electronic payment service providers, etc., for the purposes specified above.
4.2.2 Government agencies or competent officials who have the legal authority to request disclosure of personal data, including disclosure in response to a court order or to perform legal duties.
4.2.3 Legal entities in foreign countries
4.2.4 Any transferee or successor of Aeroklas or any person who may be an acquirer of the business, assets or property of Aeroklas (as the case may be) in the event of a merger or restructuring of the organization.
Aeroklas will generally transfer personal data outside of Thailand under the following circumstances:
4.3.1 In the event that personal data is disclosed and/or transferred to any overseas legal entity that has been duly authorized by Aeroklas to use such personal data for research and marketing improvement purposes.
4.3.2 In the event that personal data is disclosed and/or transferred to an agent, subsidiary or affiliate of Aeroklas where such agent, subsidiary or affiliate of Aeroklas has been duly authorized by Aeroklas to use such personal data for research and marketing improvement purposes.
4.3.3 In the event that Aeroklas is required to protect and defend its rights, interests and property.
4.3.4 Where Aeroklas deems it necessary to do so to comply with applicable laws and regulations, including but not limited to compliance with judicial processes, court orders or legal proceedings.
4.3.5 In the event that Aeroklas deems it necessary for the performance of our duties under the contract entered into with the Operator.
Destination countries may not provide an adequate level of protection for personal data as required by the PDPA. However, please be assured that any such transfer of personal data will comply with the requirements of the PDPA or other applicable data protection laws, and Aeroklas will require the recipient to implement an adequate standard of data protection that meets the requirements of the PDPA or other applicable data protection laws.
5. Your personal data rights
- Subject to the limitations and conditions of the Personal Data Protection Act, you have the following rights with respect to your personal data.
- (a) The right to request access to personal data. The right to request access to one’s personal data or to request a copy of such personal data, including a request to disclose how one has obtained one’s personal data without consent.
- (b) Right to request portability of your personal data. The right to receive your personal data in a commonly used machine-readable or automated format from You also have the right to request that Aeroklas transfer your personal data in such a format to another data controller.

Notwithstanding the foregoing, Aeroklas encourages you to contact us first to seek resolution of any issues or concerns raised.
- In the event that you wish to access or correct your personal data, Aeroklas may request you to provide personal data to verify and confirm your identity. National identification card number or passport number or company registration number are data that cannot be corrected, except when it is proven that such data is incorrect. Aeroklas will respond to your request within a reasonable time and within the time limit prescribed by law and will make every effort to respond to your request whenever possible, but to the extent permitted by law, Aeroklas reserves the right to charge you a reasonable fee for doing so.

Aeroklas will retain the Operator’s personal data for the duration of the contract and will delete/destroy it upon request, unless otherwise required or permitted by applicable law.
8. Changes to this Privacy Notice
Aeroklas reserves the right to update, amend, modify or amend this Privacy Notice at any time as Aeroklas deems necessary. We therefore strongly recommend that you review this Privacy Notice regularly. If Aeroklas decides to update, amend, modify or amend this Privacy Notice, Aeroklas will notify you via the email address you have provided to us or through any other means that Aeroklas deems appropriate so that you are informed about the processing of your personal data by Aeroklas. Any changes to this Privacy Notice will be effective from the time Aeroklas notifies you of such changes. 9. Deleting a user account
In case the user wants to delete the user account, they can notify the team to request the deletion of the user account at any time by sending an email to Dusitk@aeroklas.com to proceed with deleting the user account. After deleting the user account, your personal information on the server will be deleted and cannot be recovered.
